Jam Club Terms and Conditions
Last Updated: September 2023. Clauses 2.4, 3.6-3.7, 7.1-7.3, 8.2-8.5, 9.1-9.3, 9.6, 10 and 19.1 updated on 27 September 2026 for introductory prices, payment setup, cancellation, management review, replacement deadlines, capped cancellation refunds and full billing-error corrections, failed-payment recovery including the initial-payment final-notice window and the no-extra-fee default. For existing customers, changes follow the notice and cancellation arrangements in clause 16.2; publishing this update does not retrospectively shorten an existing payment-resolution deadline.
Standard Terms and Conditions
1. These terms may have changed since you last reviewed them
For a list of changes and when they were made, please send an email request to [email protected].
2. Where to find information about us and our services
- 2.1. We, Music Academy Midlands Ltd, provide a subscription service called “Jam Club” where you, a parent or guardian, may sign up your child (of ages 4 – 17 years only) for in-school band lessons of approximately 30 minutes in length. Most band lessons will take place during the school day however some may take place before or after the school day and you will be made aware of this when signing up.
- 2.2. If you sign up before the start of a school year (typically on or around the 1st September), we will aim to deliver no less than 33 band lessons, or 30 band lessons and up to 3 end of term concerts, (the “Full Year Sessions”) as part of the service before the end of the school year (typically on or around 25th July).
- 2.3. If you sign up after the start of the school year, we have a formula for the amount of band lessons or end of term concerts that we will aim to deliver to your child ‘pro rata’ by the end of that school year. The formula is: (Available Lessons by the end of that school year ÷ Maximum Available Lessons in a school year) x estimated Minimum Quota of lessons for each child = “Part Year Sessions”. For example:

- 2.4. Unless caused by a situation outlined in clause 8.1, if it is not possible for us to deliver the minimum amount of Part Year Sessions or Full Year Sessions (as applicable) before the end of the school year, we will provide a proportionate refund at the end of that school year for the Part Year Sessions or Full Year Sessions (as applicable) which have not yet been provided. For example, if you sign up for Part Year Sessions on 1st February and receive 17 of the target 18 band lessons or end of term concerts by the end of the school year, we will refund you for 1/18 of the total amount paid by you in accordance with clause 9.1 in that school year. When checking this annual guarantee, we take account of refunds already given for the same missed sessions so that the same shortfall is not refunded twice. The monthly cancellation-refund cap in clause 8.3 does not remove any additional refund properly due under this annual guarantee.
- 2.5. Your child will be allocated one instrument to learn at a time and, to ensure consistency and progression, your child may not change instruments each band lesson. If you would like your child to change instruments, please email us at [email protected] and we will check availability. If a request cannot be accommodated at the next band lesson, we will try to accommodate this change of instrument at the earliest opportunity.
- 2.6. We can provide all necessary equipment and instruments for each band lesson, however your child may bring their own instrument if they would prefer. Any equipment brought by you or your child will be done so at your own risk and we cannot be held responsible for any damage to or loss of your equipment, unless caused by the negligence of our teachers.
- 2.7. Your child may be given the opportunity to work towards a qualification that is delivered by us and awarded by RSL Awards. For more information, please email us at [email protected].
- 2.8. All of our teachers go through regular safeguarding training and must have an up-to-date DBS as part of their employment.
- 2.9. Please see our website or speak to our team before you sign up for other information you need to know about us and our services. We also confirm the key information to you in writing after you sign up, either by email, in your online account or on paper.
3. When you sign up to our service you are agreeing that:
- 3.1. We only accept your request to sign up to our services when we've checked them.
- 3.2. Sometimes we reject requests to sign up to our services.
- 3.3. The contract will continue until you or we end it.
- 3.4. You can end an on-going contract (find out how).
- 3.5. We're not responsible for delays outside our control.
- 3.6. Your trial is free. We explain your introductory payment and the following month's payment before collection, together with your ongoing monthly subscription.
- 3.7. Our standard failed-payment process does not add retry fees, administration charges or late-payment interest.
- 3.8. We pass on increases in VAT.
- 3.9. You're responsible for making sure details you provide are accurate.
- 3.10. We may need to charge you if you don't give us the information we need.
- 3.11. You have a legal right to change your mind.
- 3.12. You have rights if there is something wrong with your service.
- 3.13. We can change services and these terms.
- 3.14. We can suspend supply (and you have rights if we do).
- 3.15. We can withdraw services.
- 3.16. We can end our contract with you.
- 3.17. We don't compensate you for all losses caused by us or our services.
- 3.18. We use your personal data as set out in our Privacy Notice.
- 3.19. You have several options for resolving disputes with us.
- 3.20. Other important terms apply to our contract.
4. We only accept your request to sign up to our services when we've checked them
- We contact you to confirm we've received your sign up request and we accept it when we supply the service to you.
5. Sometimes we reject requests to sign up to our services
- Sometimes we reject requests to sign up to our services, for example, because a credit reference we have obtained is unsatisfactory, because you are located outside England or because the service was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid.
6. The contract will continue until you or we end it
- The contract will continue and you must continue to pay for the services until you cancel the contract as set out in clause 7 of the terms below or the contract is cancelled by us as set out in clauses 18 and 19.
7. You can end an on-going contract (find out how)
- 7.1. After your introductory month, you can end your Jam Club subscription by emailing [email protected]. If we receive your notice on or before the 20th of a calendar month, your subscription ends at the end of that month and no fee is due for the following month. If we receive your notice after the 20th, your subscription ends at the end of the following month and that following month’s normal fee remains due. Lessons remain available through the period for which you have paid, according to the school’s lesson calendar. The date we receive your notice determines the cutoff, even if we read or reply to it later.
- 7.2. During your introductory month, you can decide not to continue into the first full billing month by emailing us before that full billing month begins. The agreed introductory charge for the lessons covered remains payable, but no fee is due for the following full month. We will check any payments already arranged and confirm any cancellation or refund required.
- 7.3. We will confirm your final available lesson date, any final payment or refund, and any remaining family subscription if another child continues. If you are unhappy with the following-month charge under clause 7.1, please contact [email protected] and we will refer your case to management for a fair review. We also review exceptional circumstances such as illness, relocation or a problem with the service. If we agree an earlier end date and waive a charge, we will cancel any unneeded payment where possible. If the money has already been collected, we will arrange a refund of the agreed overpayment rather than leave it as account credit; you do not need to make a separate refund request. We will confirm the revised end date and the amount being cancelled or refunded. These arrangements do not affect your statutory rights.
8. We’re not responsible for delays outside our control
- 8.1. If the supply of our service is delayed by an event outside our control, including but not limited to pupil absence (including isolation due to illness), school closure (for any reason), school trips or inset days, we do not need to compensate you for the delay in our service and any missed band lessons will count towards your Part Year Sessions or Full Year Sessions. We will, however, do what we can to re-arrange the service or enrol your child on the next available band lesson where possible. Also, if the delay is likely to be substantial please see your remedies in clause 17 below.
- 8.2. If we or our teacher cancel a band lesson, it does not count as a delivered Part Year Session or Full Year Session. We will first try to rearrange it. We aim to confirm a suitable replacement within seven calendar days of the original cancelled lesson date and deliver it within 28 calendar days of that date. A later delivery date requires your explicit agreement. If no suitable replacement is confirmed within seven days, or it is not delivered within 28 days without an agreed extension, we will arrange a refund under clause 8.3. If we cancel the replacement too, this does not automatically restart the original deadlines.
- 8.3. For a standard parent-funded Jam Club month, the cancellation refund is £12.40 per qualifying unreplaced session, capped in total at the amount charged for that child for the calendar month in which the original sessions were due. At the current £37.20 monthly price, one session gives a £12.40 refund, two give £24.80, and three or more give £37.20. For an introductory month, the refund is the same proportion of the actual introductory charge as the number of qualifying unreplaced paid sessions bears to the total paid sessions covered by that charge. It cannot exceed the introductory charge. Free trials are excluded. We calculate the cumulative amount to the nearest penny and deduct refunds already given for those sessions. The cap belongs to the affected lesson month, even if the refund is processed later. These limits do not affect your statutory rights or the annual guarantee in clause 2.4.
- 8.4. We arrange refunds for collected amounts rather than leave account credit. If the relevant amount has not been collected, we adjust or cancel the amount due instead. We explain the affected sessions, refund or adjustment amount and its status, and reconcile any earlier refund, credit or payment correction to avoid duplicate adjustments.
- 8.5. If we verify that a payment was duplicated, overcharged or collected when it was not due, we will correct the error and refund the incorrect amount in full, allowing for any amount already refunded or returned by your bank. The lesson-cancellation refund cap in clause 8.3 does not apply to billing errors, and we do not deduct our processing costs from the correction. If the incorrect amount has not been collected, we will cancel or correct the payment where possible rather than issue a refund for money not received. We will explain the correction and address the cause of the error.
9. Your first payment and regular monthly subscription
- 9.1. The current in-school Jam Club fee is £37.20 per child per month, September to July, with no payment for August. These are equal instalments towards the annual programme, so the regular monthly amount stays the same whether a calendar month has fewer or more scheduled sessions. The introductory month is charged under clause 9.2. From the following calendar month, the normal monthly fee applies.
- 9.2. New parent-funded in-school Jam Club starters receive the following introductory prices for their trial calendar month:
Free trial only = £0
Free trial + 1 paid lesson = £9.30
Free trial + 2 paid lessons = £18.60
Free trial + 3 paid lessons = £27.90
Free trial + 4 paid lessons = £27.90
These prices apply regardless of how many sessions are scheduled for the band that month. Paid lessons are the chargeable sessions scheduled from the agreed paid start date in that calendar month. The trial and earlier sessions are excluded. The introductory month costs no more than £27.90. If delayed payment setup means paid lessons begin partway through a later calendar month, these introductory prices apply to the chargeable lessons scheduled from the agreed paid start in that later month. No charge is made for the free trial or sessions missed while setup was incomplete. The normal £37.20 monthly fee then applies from the following month, except in August. We confirm any revised payment breakdown before arranging collections. Earlier months with no chargeable lessons are not charged.
- 9.3. We normally arrange an introductory one-off payment at the earliest available Direct Debit collection date, a separate one-off payment for the first full billing month on or around the 1st (or the earliest available date afterwards), and a regular subscription from the second full billing month. No payment is charged for August, and an amount already covered by another payment is not charged again. If your introductory amount is £0, no introductory payment is taken. Before processing, we explain the agreed paid start, lessons and months covered, each one-off amount, their combined total, and the ongoing family amount and subscription start month. GoCardless sends advance notifications confirming collection dates. One-off payments may be collected close together or on the same day. When another child joins, we explain any replacement of the family subscription and charge only amounts not already covered. Any later price changes will follow clause 16.2.
- 9.4. If it is your child’s final year attending the school at which we provide the services, we will cancel your monthly subscription and direct debit payments at the end of that school year.
- 9.5. For some services, we may need to take payment differently and this will be explained to you during the signing up process.
- 9.6. If an established monthly payment due on the 1st or a new customer's initial one-off payment fails, we will contact you to explain the payment status and any action needed. Where eligible, GoCardless may automatically retry the payment up to three times within a four-week recovery window and will notify you of the collection date in advance. A retry is not guaranteed for every failed payment. Your child can continue attending during the initial recovery period. Please contact [email protected] if you need help or would like us to consider a payment arrangement. We will not arrange a duplicate collection for an amount while a retry could still collect it. The month-end process in clause 19.1 applies to established monthly payments. New customers' initial one-off payments follow the separate final-notice process in that clause.
10. Our standard failed-payment process does not add extra fees
- We do not add retry fees, administration charges or late-payment interest under our standard failed-payment recovery process. The underlying unpaid lesson or subscription amount remains to be resolved, allowing for any credit, refund or correction due. Please contact [email protected] if you need help with payment. Our recovery and place-release process is explained in clauses 9.6 and 19.1.
11. We pass on increases in VAT
- If the rate of VAT changes between the date you sign up and the date we supply the service, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.
12. You’re responsible for making sure details you provide are accurate
- If we've asked you for specific details relating to the service, including information such as contact details or special need requirements, you're responsible for making sure those details are provided promptly and are correct. If you have any questions or concerns, contact our team: [email protected].
13. We may need to charge you if you don't give us the information we need
- We charge you additional sums if you don't give us information we've asked for that is necessary for us to provide the services. For example, a failure to provide special needs information when registering for our services may mean we incur additional costs coordinating last-minute additional staff, on-site access or rescheduling the services altogether.
14. You have a legal right to change your mind
- 14.1. Your legal right to change your mind. You have 14 days after the date we confirm you have successfully signed up to our service to change your mind about signing up, but you lose the right to cancel any service when it has been completed and you must pay for any services provided up the time you cancel.
- 14.2. How to let us know and what happens next. If you change your mind contact our Team: [email protected]. We refund you as soon as possible and within 14 days of you telling us you've changed your mind. We refund you by the method you used for payment. We don't charge a fee for the refund.
15. You have rights if there is something wrong with your service
- If you think there is something wrong with your service, you must contact our Team: [email protected]. Remember too that you have several options for resolving disputes with us, as listed below in these terms.
16. WE CAN CHANGE SERVICES AND THESE TERMS
- 16.1. Changes we can always make. We can always change a service:
- 16.1.1. to reflect changes in relevant laws and regulatory requirements; and
- 16.1.2. to make minor technical adjustments and improvements, for example to address a security threat. These are changes that don't affect your use of the service.
- 16.2. Changes we can only make if we give you notice and an option to terminate. We can also make the following types of change to the service or these terms, but if we do so we'll notify you and you can then contact our Team: [email protected] to end the contract before the change takes effect and receive a refund for any services you've paid for in advance, but not received:
- 16.2.1. to make any price changes;
- 16.2.2. to make significant changes to the services; and
- 16.2.3. to make significant changes to these terms and conditions.
17. WE CAN SUSPEND SUPPLY (AND YOU HAVE RIGHTS IF WE DO)
- 17.1. We can suspend the supply of a service. We do this to:
- 17.1.1. deal with technical problems or make minor technical changes;
- 17.1.2. update the service to reflect changes in relevant laws and regulatory requirements; or
- 17.1.3. make changes to the service (see clause 16).
- 17.2. We will let you know, may adjust the price and may allow you to terminate. We contact you in advance to tell you we're suspending supply, unless the problem is urgent or an emergency. If we suspend the service for longer than 60 days in any 12-month period, we adjust the price so you don't pay for it while its suspended. If we suspend supply, or tell you we're going to suspend supply, for more than 90 days you can contact our Team: [email protected] to end the contract and we'll refund any sums you've paid in advance for services you won't receive.
18. We can withdraw services
- We can stop providing a service. We let you know at least 21 days in advance and we refund any sums you've paid in advance for services which won't be provided.
19. We can suspend or end our contract with you
We can suspend or end our contract with you for a service and claim any compensation due to us if:
- 19.1. an established monthly payment due on the 1st remains unpaid at the end of that calendar month, after we have contacted you about it and given you a final written reminder at least seven calendar days before the stated deadline. That reminder will explain the amount due and that your child's place may be released if payment remains unresolved. Before ending the place we will check the payment status and any reply or agreed arrangement. We will wait for the outcome of any retry already scheduled or processing, and honour any payment arrangement we have agreed with you. If the final reminder is sent late, the deadline will be extended to provide the full seven calendar days. We will confirm the end date and reconcile future payments so that you are not charged for services after the place ends; any amount properly due for the earlier period remains subject to your statutory rights. For new customers' initial one-off payments, this month-end rule does not apply. We will contact you about the failed payment and, where a retry is scheduled, confirm its date and ask you to have funds available. We will wait for the outcome of scheduled or processing retries. Once we have confirmed that automatic recovery has ended or no retry will take place, we will send a final written email giving you seven calendar days from the date it is sent to resolve the payment or agree an arrangement with us. Your child can continue attending during recovery and that final notice period. After the deadline, we may release the place only after checking the latest payment status, any reply, any pending retry and any arrangement agreed with you. We will confirm the end date and reconcile future payments. Existing customers retain any longer notice period that still applies until a change has taken effect under clause 16.2; or
- 19.2. you don't, within a reasonable time of us asking for it, provide us with information that we need to provide the service, for example, special needs information.
20. We don't compensate you for all losses caused by us or our services
We're responsible for losses you suffer caused by us breaking this contract unless the loss is:
- 20.1. Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your request to sign up to our services meant we should have expected it (so, in the law, the loss was unforeseeable).
- 20.2. Caused by a delaying event outside our control. As long as we have taken the steps set out in clause 7.
- 20.3. Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
- 20.4. A business loss. Our liability for any loss you suffer in connection with your trade, business, craft or profession.
21. We use your personal data as set out in our Privacy Notice
How we use any personal data you give us is set out in our Privacy Notice: https://musicacademymidlands.com/privacy-policy/.
22. You have several options for resolving disputes with us
- 22.1. Complaints. Our Team: [email protected] will do their best to resolve any problems you have with us or our services.
- 22.2. You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
23, Other important terms apply to our contract
- 23.1. We can transfer our contract with you, so that a different organisation is responsible for supplying your service. We'll contact you to let you know if we plan to do this. If you're unhappy with the transfer you can contact our Team: [email protected] to end the contract within 21 days of us telling you about it and we will refund you any payments you've made in advance for services not provided.
- 23.2. You can only transfer your contract with us to someone else if we agree to this. We may not agree if we have not received enough information about the new individual, or if we have reasonable concerns about their creditworthiness. We can require the new owner to prove you transferred the service to them, for example by written agreement.
- 23.3. Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
- 23.4. If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
- 23.5. Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
