Peripatetic Music Lessons Terms and Conditions

1. Standard Terms and Conditions
These terms and conditions apply to peripatetic music lessons delivered in schools. They may be updated periodically. To request a list of changes and the dates they were made, please email: [email protected].
2. About Our Service
2.1 Music Academy Midlands Ltd provides subscription-based, in-school instrumental music lessons for children aged 4–17. Lessons are typically 20 or 30 minutes in length and take place during the school day.
2.2 Lessons are scheduled on a rotating timetable to minimise disruption to the same curriculum subject. Schedules are confirmed after registration. While we aim for consistency, changes may occur due to school activities or other factors beyond our control. We will give as much notice as possible in such cases.
2.3 All teachers are subject to our safe recruitment process, including Enhanced DBS checks, Right to Work checks, ID verification via Credas, professional references, observed lessons, safeguarding training, and ongoing CPD.
2.4 Further service information is available on our website, or you may contact us directly. Confirmation of registration and relevant details will be sent via email.
3. Contractual Agreement
By signing up for our services, you agree to the following:

3.1 Your request to enrol is only accepted once reviewed and confirmed by us.

3.2 We may reject requests based on availability or other criteria.

3.3 The contract continues until cancelled by either party.

3.4 You can end the contract (see Section 7).

3.5 We are not responsible for delays beyond our control.

3.6 Payments are collected monthly via subscription.

3.7 Late payments may incur interest.

3.8 We pass on VAT rate increases.

3.9 You are responsible for ensuring your details are accurate.

3.10 We may charge you if required information is missing.

4. Acceptance of Service
We will confirm enrolment via email. Services begin once confirmation is sent.
5. Right to Refuse Service
We may reject requests for reasons such as limited availability, inappropriate conduct, or administrative errors. Any prepayments will be refunded if service is not provided.
6. Duration of Contract
The contract remains active and payments continue until cancelled by either party under Section 7.
7. Cancellation Policy
7.1 You may cancel by emailing [email protected] on or before the 20th of any month. The subscription will end on the 20th of that month. Cancellations received after the 20th will take effect the following month.
8. Missed Lessons & Delays
8.1 Lessons missed due to school closures, trips, or pupil absence are not refundable but may be rescheduled depending on availability.
8.2 If a lesson is missed due to teacher absence and a cover or reschedule is not possible, a refund will be issued via Direct Debit.
9. Payment Terms
9.1 Lessons are charged via monthly Direct Debit through GoCardless and collected on the 1st of each month. Payments cover lessons scheduled that calendar month.
9.2 Direct Debit reminders are issued prior to each payment. Invoices are not sent due to the fixed monthly structure.
9.3 If your Direct Debit fails, we will follow up to resolve the issue. Lessons may be paused if payment is not received.
9.4 Refunds can only be processed 7 days after the Direct Debit is collected and typically take up to 2 working days to appear.
10. Late Payments
Interest of 4% above the Bank of England base rate may be charged on overdue amounts, accruing daily from the due date until paid.
11. VAT Adjustments
If VAT rates change, your monthly fee will be updated accordingly, unless payment has already been made in full.
12. Responsibility for Information
You are responsible for ensuring all registration details and any relevant student needs are accurately provided. Missing or incorrect information may result in service disruptions.
13. Information-Dependent Charges
Additional charges may apply if missing information causes avoidable admin or delivery issues.
14. Right to Change Your Mind
14.1 You may cancel within 14 days of enrolment confirmation. If the service has begun, you will be charged pro-rata.
14.2 Refunds will be issued via the original payment method within 14 days of cancellation notice.
15. Faults or Concerns
Please contact [email protected] if you believe something is wrong with the service. We’ll investigate and respond promptly.
16. Changes to Services or Terms
We may update services or terms:

With notice for major service or pricing changes You may cancel if changes significantly impact you.
17. Service Suspension
We may temporarily suspend lessons:

For technical reasons or improvements

To comply with legal obligations

If payments are overdue If suspension exceeds 60 days, we may adjust fees. If over 90 days, you may cancel and request a refund for missed services.
18. Withdrawal of Services
We may discontinue lessons with 21 days’ notice. Any prepaid, undelivered services will be refunded.
19. Termination by Us
We may end the contract if:

There is a breach of conduct or trust
20. Limitation of Liability
We are not liable for:

Unexpected losses

Losses due to events beyond our control

21. Data Privacy

22. Dispute Resolution
22.1 Contact [email protected] for complaints. We will do our best to resolve your issue.
22.2 Legal claims may be made in accordance with English law, or your local jurisdiction in the UK.
23. Other Terms
23.1 We may transfer this contract to another provider. You may cancel within 21 days if unhappy with the transfer.
23.2 You may only transfer this contract with our written agreement.
23.3 No third party has rights under this contract.
23.4 If any part of this contract is invalidated by a court, the rest remains in effect.
23.5 Delay in enforcing the contract does not waive our right to enforce it later.
